Terms of service

Acceptance.
Plain English: Using the product means agreeing to these terms. If you don't agree, don't use it.
By accessing or using the 1891 Interpreter service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of an organization, you represent that you have authority to bind that organization.
The free Deaf-owned tier.
Plain English: Verified Deaf-owned agencies pay nothing. The verification standard is on the public site. If your ownership changes, the badge comes down.
Eligibility, verification process, and recertification are documented at /free-for-deaf-owned. Verification decisions are made by a board that includes Fallon Brizendine and rotating community advisors. Denials are reviewed by the full board on appeal.
Your data.
Plain English: Your data is yours. Export it any day. We don't sell it. We don't ransom it on cancellation.
You retain all right, title, and interest in customer data. We will provide a complete export in CSV and JSON within 5 business days of any request. Cancellation triggers an automatic export delivered to the account owner. We do not transfer or sell customer data to third parties for marketing or advertising purposes.
HIPAA.
The BAA governs all PHI processing and takes precedence over these Terms for PHI specifically.
Payment.
Paid tiers are billed monthly or annually in advance. Refunds are available pro rata for unused service if you cancel; we don't make you wait for the term to end to recoup unused months.
Acceptable use.
Don't use the Service for anything illegal, infringing, or harmful. Don't try to extract data on consumers, interpreters, or other customers outside your tenant. Don't reverse-engineer the platform to build a competing service. Be a good neighbor.
Termination.
Either party can terminate for convenience with 30 days' notice. We can suspend the Service immediately if continued operation would violate law, expose other customers to risk, or breach a third-party contract we're bound by. Suspension always includes an export window.
Limitation of liability.
To the extent permitted by law, our aggregate liability is limited to fees paid in the 12 months preceding the claim. We exclude indirect, incidental, consequential, and punitive damages. Nothing in these Terms limits liability that cannot be limited by law (e.g., gross negligence, willful misconduct).
Governing law.
These Terms are governed by the laws of Maryland, United States, without regard to conflict-of-laws principles. Venue is Frederick County, Maryland, unless we agree otherwise.
