1. The service.
1891 Arena (“the service”) is a multi-tenant sports platform operated by 1891 (“we,” “us”). You (“the customer”) subscribe to a tier and run your tournament, league, or program on it. This document is the contract between us.
2. Acceptable use.
Don’t use 1891 Arena to host illegal content, harass anyone, or upload material you don’t own the rights to. Don’t probe the platform for vulnerabilities without our written consent. Don’t use the service to run a competing platform.
3. What you own. What we own.
You own your data. Tenant program records, source documents, schedule, rosters, scores — all yours. Export anytime. Our use of your data is limited to operating the service for you.
We own the platform. The code, design system, and underlying infrastructure are ours. You get a license to use the service for the duration of your subscription; you do not get a license to copy the platform itself.
4. Payment.
You pay via our payments provider at signup. Recurring subscriptions auto-renew at the cadence you chose (monthly for Season, annual for Program). One-time setup fees are billed at signup. Your self-service billing portal is the source of truth for changes — you can switch tiers, change cards, or cancel any time.
We do not auto-charge for overage. If you hit a plan limit, we email you with options (upgrade, downgrade, archive). Surprise charges are not a thing.
5. Refunds.
- 14-day post-launch full refund on setup + first month, especially on Archive tier. No questions.
- After 14 days, the setup fee is non-refundable; subscription is cancelable but no prorated refund.
- Heirloom-scanning is refundable until we open the box. Once we’ve scanned a page, the rate applies pro-rata to scanned pages.
- Admin-error refunds (we lost a mail-in box, missed an SLA by > 5 days, delivered a site with > 10% factual errors in the archive): full refund of setup + first month, no argument.
- Live-event failures (we missed a live-scoring window for your actual game due to a platform outage): full refund of the affected month plus a free live-stream-event credit.
6. Tenancy lifecycle.
When you cancel or stop paying:
- Plan stays active through the end of the paid period.
- Then the public site enters read-only mode with a renewal banner. AI editor disabled.
- After 30 days of read-only, the site goes offline (replaced with a 410 page). Source documents queued for deletion.
- After 60 days, all source documents, your tenant data, and the change log are permanently deleted.
- You can resume anytime in the 30-day window with no rework.
- You can download a full ZIP export anytime in the 30-day window.
Records pages don’t disappear when an Archive customer cancels. The read-only banner stays on, but every link your alumni shared still works for 30 days. We do not paywall records you put together with us.
7. Service-level commitments.
- Static-first uptime: 99.9% on our edge for the live surfaces.
- Live-scoring DO failover is documented in our public LIVE_SCORING spec.
- Setup SLA: 7 business days on Bracket; 5 business days on Live; 5 business days on Archive (3 on Program-Archive).
- Support response: one business day on email; faster on concierge-hour tiers.
8. The line we won’t cross.
We do not invent facts about your program’s history. If your scorebook doesn’t say it, we leave the field empty. The AI editor proposes; you approve. Every fact on a public records page is anchored to a source quote you can verify.
9. Liability.
The service is provided “as is.” To the maximum extent permitted by law, our aggregate liability is limited to the fees you paid in the prior 12 months. We’re not liable for indirect or consequential damages.
10. Changes to these terms.
If we materially change these terms, we’ll email all active customers at least 30 days before the new terms take effect. You can cancel without penalty in that window.
